Since the founding of Coleman & Balogh in January 2007, we have secured a number of important victories for our clients, including the following:
United States v. an Individual, (N.D. Cal. 2010): As trial counsel, obtained dismissal of three-count indictment in the midst of a three-day evidentiary hearing in support of our motion to suppress evidence obtained from an unlawful search.
California v. an Individual, (Marin Superior Court 2010): As trial counsel, obtained Order suppressing all evidence arising from illegal arrest, leading to dismissal of all charges in an unpublished decision.
United States v. an Individual, (N.D. Cal. 2010): As trial counsel, obtained dismissal with prejudice of five-count indictment charging our client with criminal contempt of court.
United States v. an Individual, (N.D. Cal. 2010): As habeas counsel, vacated unlawful sentence and terminated case in proceedings commenced under 28 U.S.C. § 2255.
United States v. an Individual, (N.D. Cal. 2009): In this serious matter arising under Title 21 and requiring a mandatory minimum sentence of 10 years upon conviction, acquitted client of both counts of the indictment and also of lesser-included conspiracy offense.
United States v. an Individual, (N.D. Cal. 2009): In this serious matter arising under Title 21, persuaded district court to strike down United States Attorney’s notorious “priors policy” which threatened our client with a minimum sentence of 20 years upon any conviction. Thereafter, the government agreed to dismiss all charges of the indictment (calling for a 10-year minimum sentence upon conviction) in favor of a stipulated term of probation based on a plea to the lesser offense of misprision of felony.
United States v. Comprehensive Drug Testing, Inc., 579 F.3d 989 (9th Cir. 2009) (en banc): As trial counsel (with co-counsel), secured four district court orders in three separate judicial districts (San Francisco, Los Angeles, and Las Vegas) finding the government had “callously disregarded” the constitutional rights of professional athletes to keep their drug-testing records private and requiring the return of seized records to the testing agency and, as appellate counsel (with co-counsel), obtained complete affirmances of these rulings from an en banc panel of the Ninth Circuit.
United States v. an Individual, (9th Cir. 2009): As appellate counsel in case arising from supervised release revocation, vacated term of supervised release imposed by district court and had it reduced from three years to one year. (Unpublished decision)
United States v. an Individual, (9th 2009): As appellate counsel, obtained reversal of client’s sentence for second time before the Ninth Circuit. On remand before the district court, client’s sentence was reduced by almost five years. (Unpublished decision)
United States v. Williams, 547 F.3d 1187 (9th Cir. 2008): As appellate counsel, obtained complete reversal of all counts of conviction in a conspiracy, Hobbs Act, drug trafficking, and firearms case.
United States v. an Individual, (C.D. Cal. 2008): Obtained dismissal with prejudice of 40-count indictment alleging theft of federal funds.
United States v. an Individual, (N.D. Cal. 2008): In this tax and fraud matter, successfully vacated all counts of conviction before United States District Court in an unpublished decision.
United States v. an Individual, (C.D. Cal. 2008): In this fraud and embezzlement matter, successfully overturned all counts of convictions through habeas corpus proceedings before the United States District Court in an unpublished decision.
CFTC v. an Individual, (2008): In this investigation commenced by the Commodities Futures Trading Commission, convinced the Commission to forego any regulatory action in response to allegations of misconduct.
United States v. Forrester, 512 F.3d 500 (9th Cir. 2008): As appellate counsel, obtained reversal of all counts of conviction in this conspiracy case.
United States v. an Individual, (9th Cir. 2007): As appellate counsel, obtained reversal of all counts of conviction in this counterfeiting case. (Unpublished decision)
United States v. an Individual, (9th Cir. 2007): As appellate counsel, obtained reversal of all counts of conviction in this bank fraud case. (Unpublished decision)
California v. an Individual, (San Mateo Superior Court 2007): As trial counsel, obtained Order suppressing all evidence arising from illegal arrest, leading to dismissal of all charges in an unpublished decision.
United States v. an Individual, (S.D. Cal. 2007): As appointed "death" counsel in federal capital case, presented venue defenses to main Justice in successful effort to convince the government to forego the death penalty.
State Farm Insurance Company v. an Individual, (Los Angeles Superior Court 2007): As trial counsel, obtained dismissal with prejudice of all counts in response to the filing of a demurrer.
